Phase II: Negotiating up to Deeds Exchange at the Notary
This phase in the purchase process consists of several steps to get from negotiating the price of the property and the purchase conditions to reaching an agreement, signing the reservation contract and the final contract, the legal checks, to finally signing at the notary. This is also the phase where the international buyer needs to be prepared for the purchase in Spain. Things like applying for the Spanish NIE number, opening the Spanish bank account and preparing the financing also take place in this phase.
The Legal Process when Buying a Property in Spain
Specifically, the legal checks are an important part of the house purchase in Spain. This is mainly becausein Spain every state, province and even every municipality can have its own laws and regulations, that there are multiple registration systems of houses and plots of land (cadastre and register), which serve different purposes and in practice often do not correspond to each other, nor to the real situation. Specifically, this means, for example, that in reality there is a nice big house with outbuildings and swimming pool on the plot, that in the land register only a small main house is known and that in the register only a plot with storage space is known. Frequently, it is possible to resolve this and get the land, house and outbuildings fully registered, but often not. For example, if it is a protected area and the plot has no residential use according to the zoning plan. Hence, the legal process is an important part of the purchase process, first to uncover the correct and complete information and later to get any necessary legalisations carried out.
